I'm confused about the question. Are you asking if there is anything she could do to keep the house?

If you are asking if there is anything she can do to keep the house then most likely NO since her name is not on the mortgage. Unless she wants to bid on it, since it's being auctioned off.

Unless she wants to bid on it, since it's being auctioned off. That's what I was thinking. Since she wasn't on the mortgage, she was basically a renter. When a rental property forcloses, tenants get f cked. That happened to a friend of mine. Their landlord was taking their rent money and doing something else with it, and they got kicked out. He didn't even have the decency to warn them.

Oh, I didn't realize that was what you're asking. If they do, she could always file a civil suit later against her friend who owned the house if she can prove that she was paying rent to him and was unaware that the house was forclosing. It also might vary on the state, so their best bet is to talk to a lawyer in their state.

I believe she will loose everything and then have to file a lawsuit to get her value. She may be able to go to the police department if she can prove that she was paying rent. Sadly small claims only cover up to a certain amount which may not cover the value of her stuff.

I just thought about it, and if this person doesn't have the money to pay the mortgage, they probably won't have the money to pay your family member back anyhow. I don't know if the police will get involved. Most police departments say something like this is a civil matter and to handle it in court. I guess if they are in an area where the police aren't very busy and there isn't much going on they may help them out. It's worth a shot.

Wait what are you asking??? WHat are her rights, is she still living there and wants to stay, does she still have to pay rent? Did they lock it up with her stuff still inside?

He just decided he doesn't want the house anymore. So rather than try to sell it, he just stops paying the mortgage and ruins his credit? Sounds intelligent.

My mom foreclosed on her home :( She had to apply for bankruptcy and had a certain amount of time to get everything out of the house before it was foreclosed on. It took quite awhile for them to actually take possession and lock it up though. Your friend should start storing stuff elsewhere just to be safe though. I'm not sure if they will automatically take possession after the auction or what.

Ah. Well hopefully she can get it all out. My mom left a lot behind because her new place is smaller and we had lived in that house for 20 years so there was a lot of random crap. I'm so sad that I'll never be able to go back to it...and the fact that strangers pretty much went through my life and threw everything away :( It's a sad thing.

I believe with a forclosure the person or person's living in the house have so many days to get their things out. I don't think they can just "keep" everything. Now after so many days of not moving anything out after they are warned they may be able to. Unless this is an estate auction if that is the case your friend needs to hurry up and get her crap out while she still can.

Is her name on a lease with the house owner? If so she has rights even if the house is being forclosed on...if not I believe once it is auctioned they lock it that day....

OTR I know you said you did a search but use bing.com and type in foreclosure and renter's rights. I find I get more info on bing than google somethimes. FYI: alot popped up under that search.

My daddy got the house my sister and I are moving into, via foreclosure. But that doesn't help much sorry o.o

that's how my cousin got his 5 bedroom house... foreclosure sale. the original owners had lost a tarantula a year before.. they found it. crawling across their laundry room. they put it in a terarium and kept it. ew.

Best thing to do is to pack her stuff up & be ready to move. Find a place to stay & if it is not enough to accommodate her stuff, get storage space. She has to get out of there anyhow. :>

Every state is different. In Illinois, the sheriff comes and kicks you out and all of your sh!t gets moved to the front lawn. It happened to our old neighbors. It was really sad seeing their 3 year old daughter's bed being carried out onto the lawn with all of her stuffed animals on it. After everything was moved out, the sheriff locked the house up and the family had to rent a moving truck to move all of their stuff.

After everything was moved out, the sheriff locked the house up and the family had to rent a moving truck to move all of their stuff.  Planning it would be so much better. Less embarrassing too. It's pretty straightforward. There is nothing she can do but move within the time limit.

Most people get "warnings" before being evicted or forclosed on since it's usually due to lack of payments. They can't just "kick" you out. In otr's friends case I'd say she is just screwed and needs to move her stuff asap.
